This topic reached its peak in the 20th century. Since legal systems are formed based on the majority vote, respecting the rights of minorities in these systems is one of the essential concerns of human rights. The present study aims to answer the question of what is the status of minority groups in the systems affected by international documents and the divine system reflected in Malik Ashtar's treaty (letter 53 of Nahj al-Balagheh). Based on this, the present research with the library and descriptive-analytical method aims to study the differences between the two systems comparatively. According to the results of the rule of Imam Ali (AS), that is; a thousand years ago, attention was paid to the rights of minorities, and the Alavi seerah tried to reduce the differences between minorities. According to the governmental policy and Imam Ali's (AS) statements in Nahj al-Balaghah, particularly the Malik Ashtar's treaty, legal obligations towards minorities are positive and mandatory, and in establishing the rights of minorities, attention has been paid to the (material and spiritual) aspects of human beings. But in international documents, the borders between minority groups are highlighted; the rights of minorities are based on individual originality, and the obligations of governments in treaties are privative.}, keywords = {minorities' rights,comparative study,Imam Ali (AS),Nahj al-Balaghah,Malik Ashtar treaty,International Documents}, title_fa = {مطالعه تطبیقی حقوق اقلیتها در اسلام با تکیه بر عهدنامه مالک-اشتر و اسناد بین‌المللی}, abstract_fa = {آغاز توجه به حقوق گروه‌های اقلیت به عنوان بخشی از حقوق بشر و به عنوان یکی از مباحث بین المللی به  قرن نوزدهم میلادی بر می‌گردد که در قرن بیستم به اوج خود رسید. از آنجائی که نظام‌های حقوقی بر پایه رای اکثریت شکل می‌گیرد و رعایت حقوق اقلیت‌ها در این نظام‌ها از دغدغه‌های مهم حقوق بشر است، جایگاه گروه‌های اقلیت در نظام‌های متأثر از اسناد بین المللی و نظام الهی انعکاس یافتهِ در عهدنامه مالک اشتر (نامه 53 نهج البلاغه) چگونه است؟ بر این اساس پژوهش حاضر با روش کتابخانه ای؛ توصیفی - تحلیلی  به مطالعه تطبیقی و وجوه تمایز دو نظام مذکور پرداخته و حاصل اینکه در حکومت امام علی علیه السلام یعنی؛ هزار سال پیش‌تر از سایر جوامع به حقوق اقلیت‌ها توجه شده است و در نظام علوی سعی بر کاهش فاصله‌های میان اقلیت‌ها شده است. بر اساس سیره حکومتی و فرمایشات امام علی علیه السلام در نهج‌البلاغه بویژه عهدنامه مالک اشتر تعهدات حقوقی نسبت به اقلیت‌ها ایجابی و الزامی است و در وضع حقوق اقلیت‌ها به جوانب (مادی و معنوی) انسان توجه شده است اما در اسناد بین المللی ضمن پر رنگ جلوه‌دادنِ مرزهای بین گروه‌های اقلیت، حقوق اقلیت‌ها بر اساس اصالت فردی است و تعهدات دولت‌ها در معاهدات سلبی است.}, keywords_fa = {حقوق اقلیت‌ها,مطالعه تطبیقی,امام علی علیه السلام,نهج البلاغه,عهدنامه مالکاشتر,اسناد بین المللی}, url = {https://www.nahjmagz.ir/article_171002.html}, eprint = {https://www.nahjmagz.ir/article_171002_431086faf1e8ea2feb2d6aa6c626ef61.pdf} }
